ICJ Betrays Humanity, Overlooks Genocidal acts of Hamas Jihadists
The International Court of Justice (ICJ) has again blackened its own face, tarnishing own image as a biased agency in their latest verdict in the Israel-Hamas war. The case was filed by South Africa. Earlier they had seriously erred in their verdict against the Russians in Russia Ukraine war. However, there seems to be a distinction between the two verdicts. In the case of Russia, they delivered their verdict even without listening to the Russian side but in the present case against Israel, they did listen to both sides yet remained mum to Hamas genocidal terror attacks of 7th Oct 2023 on Jews. Justifiably, Israeli authorities have put a serious question mark on the verdict because of the court missing out the primary issue of Hamas attack. Both ICJ as well as the pleaders of South Africa have only taken consideration of Israeli retaliation that is the right of any sovereign nation. In the verdict, among other matters, the court has meekly requested Hamas to release the Israeli hostages and asked Israel to take precaution against Palestinian genocide. There is no mention of any action against the Jihadi culprits of 7th Oct 2023 nor to redress genocidal contents in the ethos of Hamas or other Jihadi organisations against Jews.
It is unfortunate that there is serious issue of overlooking the inaudible voices of the minorities in world across nations and Jews are one of such voices which has faced genocide in past. Today the entire world seems to have forgotten the shrill cries and chilling experience of the Israeli women, girls, other children including toddlers and elderly alike, in the genocidal terror attack by Hamas Jihadists (read “Jihadists are threat to world, not only to Israel”, https://thecounterviews.in/articles/jihadists-are-threat-to-world-not-only-to-israel/). The biased judiciary of the ICJ seems to have ignored those soul-tormenting videos in which Hamas Jihadists raped women & girls and burned them alive. They shot the toddlers from point blank ranges as an instrument of hate expressed in their vision document. Their vision document proclaims nothing short of genocide of the Jews. The ICJ also seems to have blinked to Hamas acts of inhuman behaviour in which they had taken 240-odd unarmed civilians and few off-duty soldiers as hostage which they are using as a tool of blackmail to get Jihadi criminals exchanged from Israeli jails (read “Jihadi beasthood shaming humanity; Jews, Yezidis, Kashmiri Pandits or Others” https://thecounterviews.in/articles/jihadi-beasthood-shaming-humanity-jews-yezidis-kashmiri-pandits-or-others/). Although the author of this article has not yet gone through the entire verdict pronounced today, the writing is very much on the wall as well as on the lips of every person with slightest of the knowledge of Human Rights, “ICJ has erred by betraying humanity”.
ICJ seems to have forgotten that their primary role is to do justice to wrong happenings at the international levels beyond the jurisdictions of the Supreme Courts of the member nations. It is very unfortunate that in the absence of their administrative hold on the member nations or the warring nations, they don’t insist on an impartial and transparent investigation or the fact-finding report before listening to the arguments. It was absolutely vital for them to have started the case from the point of Hamas acts of inhumanity of 7th Oct 2023 on Israeli territory to which Israel retaliated as their right. This was not an isolated act of Hamas, one of the 175-odd jihadi tanzeems in the world. Hamas acts were very much in line with their vision document to wipe out the Jews of Israel. The article points out as to how Quran violates the fundamental rights of all non-Muslims. At times, their cruelties go beyond to attack even Muslims of other sects. ICJ should have first indicted HAMAS for their genocidal vision document and suggested to amend Quran for those hateful verses against humanity (read “Quran incompatible for Secular Ethos: Lessons from Hamas”, https://thecounterviews.in/articles/quran-incompatible-for-secular-ethos-lessons-from-hamas/). There are at least 60 verses of discrimination, hate and intolerance in Quran against the believers of other faiths and religions (read “60 hateful & intolerant verses of Quran” parts 1 & 2, https://thecounterviews.in/articles/60-hateful-intolerant-verses-quran-part-1/; and https://thecounterviews.in/articles/60-hateful-intolerant-verses-quran-part-2/). These hateful verses of Quran are unacceptable in any democratic, secular and non-Islamic society or the nations. It merits being either amended or banned. International agencies of Human Rights must take accounts of the hate elements in it and initiate its rectification as a first step towards lasting peace in the world where mostly Islamists are indulging in violence (read “Major Jihadi attacks in the world”, https://thecounterviews.in/articles/major-islamic-jihadi-attacks-in-the-world/).
Coming back to the ICJ judgement, it is unfortunate that the highest court of law in the world has erred. There is no doubt that in the rightful counterstrike of Israel against Hamas, there are many innocent civilians too who are becoming victims of war. It will be interesting to know as to who are innocent civilians in Gaza (read “Gaza of Jihadists, sympathizers and innocent civilians” https://thecounterviews.in/articles/gaza-of-jihadists-sympathisers-and-innocent-palestinians/). There is no independent count of the deaths of innocent civilians but that is not a matter of discussion as every human life is precious. There is an urgent need to find out as to how the civilians continue to shield Hamas terrorists against Israeli attacks on their tunnel systems mostly opening in multistorey budlings, schools, mosques and other public places. Using civilians as shields are genocidal acts of Hamas. While every agency is trying to pressurize Israel to stop attacks and observe permanent ceasefire, none is talking of those unfortunate Israeli hostages of 7th Oct 2023 undergoing torture under Hamas captivity or the perpetrators of that violence. If some international agencies show wisdom to address the most fundamental issue as mentioned in the report referred below, the war can be ended. Any war brings cruelty to humanity and the most number of victims are the innocent people. However, Hamas is fighting a Jihad against Jews of Israel and Quran/Hadith incites every Muslim, men or women, boys or girls, young or old to join jihad. Hence, it is extremely difficult to say as to who are innocent civilians in Hamas ruled Gaza. There is no doubt on the numerous casualties on both warring sides but more on Hamas/Palestinian side. ICJ has given their verdict in the absence of an independent and transparent investigation or a fact-finding report which is inappropriate. They seem to have totally overlooked the seed of the present conflict and thus failing to indict Hamas for their inhuman acts. In the modern world, jihad is an unacceptable concept of Islam, inimical to the non-Muslims. Israel-Hamas war must end at the earliest but there should be justice for both sides. In the present verdict, ICJ seems to have condoned the inhuman acts of Hamas Jihadists on Israeli territory on 7th Oct 2023. This could be one of the dark moments for the ICJ in rendering their verdict the way they have.
